The first introductory circle rejected International Criminal Court Israel’s request to cancel the arrest warrants and suspend the investigation against the Israeli Prime Minister Benjamin NetanyahuAnd his former defense minister Yoaf Gallant.
In a decision issued on Wednesday, the first preliminary department announced its rejection of the request submitted by Israel on May 9, 2025, to cancel the arrest warrants and suspend the investigation against Netanyahu and Gallant.
The court explained that Israel had submitted two separate requests in this case. Palestine.
The court ended in its decision to reject the justifications for the objection submitted by Israel, in which it said that the International Criminal Court is not competent to consider the crimes committed on the Palestinian territories.
The department indicated that, according to Article 19 (7) of the Rome Basic System, the suspension of the investigation only applies when a state is stabbed in the acceptance of the lawsuit, but Israel did not challenge the “acceptance” of the investigation.
At the same time, the court refused to request Palestine to submit a statement in the event of approval of Israel’s request, noting that the court has sufficient information on the issue, and that there is no need for additional information or data.
Decision background
On February 5, 2021, the International Criminal Court ruled that Palestine is a state party to the Rome Basic System, and that the court’s jurisdiction over the Palestinian territories extends to Gaza and the occupied West Bank since 1967.
On March 3, 2021, the Prosecutor’s Office announced the start of an investigation into the Palestinian situation.
Israel objected to the jurisdiction of the court on September 23, 2024, according to Article 19 (2) of the Rome Basic System.
On November 21, 2024, the first preliminary department in the International Criminal Court issued arrest warrants against Netanyahu and Gallant on charges of war crimes and crimes against humanity.
Israel, with American support, has launched, since October 7, 2023, genocide crimes in Gaza that include killing, starvation, destruction and forced displacement, which left more than 198,000 Palestinians between dead and wounded, most of them children and women, and more than 10,000 missing, as well as hundreds of thousands of displaced people.
